1. “Players”: Individuals or end-users who access, view, or otherwise interact with cloud gaming streams through embedded iframes or YOM’s platform.
2. “Studios”: Entities or individuals who host or provide game content on YOM’s infrastructure, subject to a subscription or usage fee.
3. “Node Operators”: Entities or individuals who provide server resources or host nodes for YOM’s cloud gaming network, potentially earning $YOM tokens through on-chain reward mechanisms.
4. “Content”: All text, graphics, audio, video, software, data, or other materials displayed or transmitted via the Services (including game streams).
Acceptance. By accessing or using the Services, you represent that you are of legal age (at least 18 years old) and capable of forming a binding contract.
Modifications. We may, at our sole discretion, amend or update these Terms from time to time. We will post the revised Terms with an updated “Last Updated” date. Your continued use of the Services after the changes become effective constitutes acceptance of the revised Terms.
Infrastructure Provision. YOM provides an online cloud gaming platform wherein:
No Content Moderation. YOM does not actively create or moderate the game content. Studios bear sole responsibility for the legality, reliability, and appropriateness of all streamed materials.
Advertising & Monetization. YOM may display or integrate third-party advertising within or around embedded streams to subsidize or fund the cloud gaming service. Your interactions with such advertising are at your own risk.
On-Chain Rewards. Node Operators may earn $YOM tokens distributed via an on-chain Proof-of-Work or performance mechanism. YOM does not guarantee any specific rewards or valuations and disclaims liability for any fluctuations or losses associated with cryptocurrency markets.
Compliance. You must comply with all applicable local, state, national, and international laws.
Account/Wallet. Certain features may require signing in via third-party providers (e.g., Telegram, wallet). You are responsible for maintaining the security of those accounts.
Content Interaction. You understand that the displayed streams might contain third-party or studio content. YOM is merely a conduit and does not endorse or validate such content.
License & Rights. By hosting or embedding your game streams through YOM, you represent and warrant that you have all necessary rights and licenses to distribute, stream, or display the content.
Subscription & Fees. You agree to pay the monthly or usage-based subscription fees, typically handled via a third-party payment processor (e.g., Bitpay).
Prohibited Content. You will not stream content that is unlawful, infringing, or otherwise in violation of any third-party rights or these Terms.
Content Liability. You acknowledge full liability for any claims arising from your game content, and you agree to indemnify YOM as set out in Section 11.
Infrastructure. You agree to maintain and operate servers or nodes in accordance with YOM’s technical guidelines and applicable laws.
Reward Distribution. Rewards (e.g., $YOM tokens) are governed by on-chain mechanisms. YOM is not responsible for token volatility, network congestion, or any crypto-related losses.
Compliance & Security. Node operators must ensure they do not introduce malicious code or compromise the integrity of YOM’s network.
Accurate Information. If you create an account or provide any registration data, you must ensure it is accurate, current, and complete.
Security. You are solely responsible for safeguarding your login credentials. Any unauthorized activity under your account is your responsibility. Immediately notify YOM of suspected breaches or unauthorized use.
Suspension/Termination. YOM reserves the right to suspend or terminate any account that appears to violate these Terms, infringe intellectual property, or engage in fraudulent or unlawful activity.
You agree not to:
YOM IP. All logos, trademarks, and software code relating to YOM remain our property or that of our licensors. You must not copy, modify, distribute, or reverse-engineer our materials without express written permission.
Third-Party IP. Some embedded or streamed content may belong to third parties or studios. You must not reuse or reproduce such content unless expressly authorized by the relevant rights holder.
THE SERVICES (INCLUDING ALL CONTENT, EMBEDDED STREAMS, AND ADVERTISEMENTS) ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, YOM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR MALICIOUS CODE. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
YOM respects intellectual property rights. If you believe your copyrighted work is being used without authorization via the Services, please send a notice (e.g., a DMCA takedown) to info@yom.net. Upon valid notice, we may remove or disable access to infringing content.
You agree to defend, indemnify, and hold harmless YOM and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles.
Jurisdiction. You agree to submit to the exclusive jurisdiction of the competent courts located in the Netherlands for resolution of any disputes arising out of or related to these Terms or the Services.
Voluntary Termination. You may cease using the Services at any time.
Termination by YOM. We may suspend or terminate your access to the Services if we determine, in our sole discretion, that you have violated these Terms or applicable law, or if we discontinue the Services.
Effect of Termination. All rights and licenses granted to you shall immediately cease, and Sections that by their nature should survive (e.g., Indemnification, Disclaimer of Warranties, Limitation of Liability) shall remain in effect.
Entire Agreement. These Terms, together with our Privacy Policy and any additional guidelines referenced, constitute the entire agreement between you and YOM regarding the Services.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Failure by YOM to enforce any provision does not waive future enforcement of that or any other provision.
Force Majeure. YOM is not liable for any delay or failure resulting from causes beyond its reasonable control (e.g., natural disasters, war, terrorism, labor disputes, or government actions).
